Terms and Conditions of Use

 

If you browse and use this Website you are agreeing to comply with and be bound by the following terms and conditions of use, which together with our privacy policy govern The Wedding Community’s relationship with you in relation to this website.

 

1.  Definitions

 

In these terms and conditions the following terms shall have the following respective meanings unless the context otherwise requires.

 

 “The Company” refers to The Wedding Community Limited (Company Registration Number 6937382) whose registered office is situated at 23 Sanway Close, Byfleet, Surrey, KT14 7SP.

 

“User” refers to the User and/or company which the User represents.

 

“The Website” refers to www.theweddingcommunity.com.

 

The use of the Website is subject to the following terms of use:

 

2.         Content of the Website

 

2.1        The content of the pages of this Website is for the User’s general information and non-commercial use only. It is subject to change without notice.  If the User is a business, the User should refer to the Company’s Terms and Conditions of Advertising.

 

2.2        Any views or opinions expressed on the Website do not necessarily represent the views of the Company.

 

2.3        This Website contains material which is owned by or licensed to the Company. This material includes, but is not limited to, the design, layout, look, copy, appearance and graphics. Reproduction is prohibited other than in accordance with the copyright notice, which forms part of these terms and conditions.

 

2.4        All trademarks reproduced in this website, which are not the property of, or licensed to the Company, are acknowledged on the website.

 

3.         Membership Accounts

 

3.1        The User confirms that any information provided is accurate and complete at the time provided.

 

3.2        The User agrees to update any information as required by the Company in order that its records may be kept accurate and complete.  Failure to update the User’s relevant information shall be considered reasonable grounds for the Company to suspend or terminate the User’s  account and refuse the User service in the future.

 

3.3        The User must not impersonate another person or business.

 

3.4        The User must not create another membership account on the Website if the User’s membership account is suspended or terminated for any reason, unless the User has the Company’s written permission to do so.

 

3.5        The User must never use another member’s account without permission.

 

3.6        The User shall be solely responsible for the activity that occurs on its membership account.

 

3.7        The User must keep its membership account password secure and notify the Company immediately if it feels there has been any unauthorised use of its account. The Company will not be liable for any losses caused by any unauthorised use of an User’s account.

 

3.8        Unauthorised use of this website may give rise to a claim for damages and/or constitute a criminal offence.

 

4.         Regulation of Membership Accounts

 

4.1        The User will not use language including but not limited to content or user names that contains swear words or language which may offend. This includes swear words with asterisks replacing some letters.

 

4.2        The User will not post material including but not limited to photo’s, videos, articles and comments that contain material that may offend, is unlawful, defamatory, libellous, threatening or encourages conduct that would be considered a criminal offence, violate any law or is otherwise inappropriate.

 

4.3        The User will not post any advertisements for businesses or services, unless they are a registered supplier, venue or accommodation in the Website’s directory.

 

4.4        The User will be solely responsible for its own user submissions and the consequences of posting or publishing them.  The Company reserves the right to remove content for any reason.

 

5.         User’s Rights and Permissions

 

5.1        the User confirms that by posting or publishing content that it has the necessary licenses, rights and permission to do so and that the material is not copyrighted, protected by trade secret or otherwise subject to third party rights, including privacy and publicity rights, unless the User is the owner of such rights or has permission from their rightful owner to post the material.

 

5.2        Videos are added to the website via www.youtube.com.  By uploading or using videos via www.youtube.com the User is agreeing to the terms and conditions and privacy policy set out on www.youtube.com.

 

6.         User Forum

 

6.1        Only Users who are existing members of the Website are able to participate in discussions on the user forum.

 

6.2        Users may apply for membership of the Website for free at: www.theweddingcommunity.com/signup.

 

6.3        If the User is a company it must have a listing in the Website’s directory in order to view and contribute to discussions on the user forum.

 

6.4        A User company can apply for a listing in The Wedding Community’s directory at: www.theweddingcommunity.com/signup

 

7.       User Forum Terms and Conditions

 

The utilisation of the User Forum is subject to the following additional terms of use as set out in this Clause 7:           

7.1        The Company reserves the right to remove, edit, move or modify the discussions pages.

 

7.2        The Company reserves the right to remove without notice any comment or material that it deems to be offensive.  As a result the member may have their member account suspended or removed without notice.

 

7.3        All comments posted on the discussion forum pages express the views of and are the responsibility of the author.  The Company accepts no responsibility for any comment or content posted.

 

7.4        The User will not post material/comments that 

  • Discuss any active court cases. 
  • Advertise products, goods, services, businesses, other websites or forums/discussions with the exception of the “Wanted” Discussions section, where only businesses that have a listing in the Company’s directory may reply to members’ posts and start new topics in order to promote their goods or services. 
  • Include URL’s of or images hosted on third party websites that may offend or contain illegal material. 
  • Includes either the User or someone else’s personal details such as telephone numbers and addresses. 
  • May be considered spam.  

8.         Suspension of Services

 

The Company cannot guarantee uninterrupted access the website.   For the avoidance of doubt, the Company shall not be liable to the User for any interruption or delay that the User may experience in accessing the website, whatever the cause.

 

9.         Termination

 

9.1        Any Agreement made under these Terms and Conditions by the User and the Company may be terminated by the Company providing notice of its intention to terminate to the User in writing on the occurrence of any of the following events:

 

9.1.1     If the User fails to settle an invoice within seven days of receipt.

 

9.1.2     If the User shall be in breach any of the terms and conditions hereby set out.

 

10.       Non-Endorsement

 

This Website may include links to other websites. These links are provided for the convenience of the User and to provide further information. They do not signify that the Company endorses the linked website(s). The Company has no responsibility for the content of the linked website(s).

 

11.       Limitation of Liability

 

11.1      Neither the Company nor any third parties provide any warranty or guarantee as to the accuracy, timeliness, performance, completeness or suitability of the information and materials found or offered on this Website for any particular purpose. The User acknowledges that such information and materials may contain inaccuracies or errors and the Company expressly excludes liability for any such inaccuracies or errors to the fullest extent permitted by law.

 

11.2      The User’s use of any information, materials or planning tools on this Website is entirely at the User’s own risk, for which the Company shall not be liable. It shall be the User’s own responsibility to ensure that any products, services or information available through this Website meet the User’s specific requirements.

 

12.       Continuing Force and Effect of these Terms and Conditions

 

The invalidity, illegality and unenforceability of any provision of these Terms and Conditions shall not affect or impact the continuation in force of the remainder of these Terms and Conditions.

 

13.       Whole Agreement

 

These Terms and Conditions (as amended from time to time) together with any document expressly referred to in any of the terms contain the entire agreement between the parties.

 

14.       Jurisdiction

 

These Terms and Conditions shall be governed and construed in accordance with English Law and the parties hereby agree to submit to the non-exclusive jurisdiction of the English Courts in respect of any dispute or matter arising out of or connected with these Terms and Conditions.

Should you place an order to advertise on this website or with the Company you are agreeing to comply with and be bound by the following terms and conditions of advertising along with the terms and conditions of use, which together with our privacy policy govern The Wedding Community’s relationship with you in relation to this website.

 

1.  Definitions

 

In these terms and conditions the following terms shall have the following respective meanings unless the context otherwise requires.

 

 “The Company” refers to The Wedding Community Limited (Company Registration Number 6937382) whose registered office is situated at 23 Sanway Close, Byfleet, Surrey, KT14 7SP.

 

“User” refers to the User and/or company which the User represents.

 

“The Website” refers to www.theweddingcommunity.com.

 

“Services” refers to the product or services that the User is ordering from the Company.

 

“Order” refers to an order placed by the User via the Website or other means for Services.

 

2.         Terms of Payment

 

2.1        Payment for the Services shall be the value stipulated on the invoice sent by the Company to the User.

 

2.2        For the avoidance of doubt VAT is chargeable in respect of all Services.

 

2.3        Payments must be made in full, including VAT within seven days of receipt by the User of the invoice.    For the avoidance of doubt if the invoice is sent to the User via Royal Mail First Class Post or electronic mail, deemed delivery will be the second day after the document was posted.

 

2.4        If any payment is not received within seven days of receipt by the User of the invoice, rejected or refused, the payment will be treated as overdue and the Company shall be entitled to cancel the Order.

 

3.         Provision of Services

 

3.1        Services will only be accessible or supplied once cleared payment has been received in full by the Company.

 

3.2        The Company reserves the right not to accept an Order for any reason and to withdraw services at any time.  If services are withdrawn following receipt of the payment in full by the User, the Company shall refund the payment on a pro-rata basis, taking account of Services requested, and length of time services provided by Company (if at all).

 

4.         Suspension of Services

 

4.1        The Company may have to suspend services for maintenance, improvement or repair.  In this instance the service will be restored as quickly as is reasonably practicable.  For the avoidance of doubt no pro-rata refund shall be available to the User in such instance.

 

4.2        The Company does not provide any guarantee or warranty that the Services supplied will be secure, uninterrupted or error free.

 

5.         Information supplied by the User

 

5.1        The User will be responsible for keeping any directory listing information up to date and must inform the Company of any changes to the User’s account information.

 

5.2        The Company reserves the right to remove or refuse any content provided or uploaded by the User that is deemed inappropriate and/or offensive.

 

6.         Termination

 

6.1        Any Agreement made under these Terms and Conditions by the User and the Company may be terminated by the Company providing notice of its intention to terminate to the User in writing on the occurrence of any of the following events:

 

6.1.1     If the User fails to settle the invoice within seven days of receipt.

 

6.1.2    If the User shall be in breach any of the terms and conditions hereby set out.

 

7.         Limitation of Liability

 

7.1        Save in the event of fraud, the Company shall not be liable in contract, tort or otherwise (including, without limitation, negligence) in connection with these terms and conditions for:-

  • Any economic losses (including without limitation loss of revenues, profits, contracts, business, goodwill or reputation)
  • Any special, indirect or consequential losses 

7.2        Subject to the above, the Company’s liability shall be limited to the removal within a reasonable period of any inaccurate data generated on its website.

 

8.         Continuing Force and Effect of these Terms and Conditions
